The Applicant desires to participate on the 261 Fearless team in the 2019 TCS New York City Marathon to be held in New York City, November 3, 2019. Applicant hereby acknowledges and agrees that registration in the race as a member of the 261 Fearless Charity Team will be subject to confirmation of acceptance and approval of applicant’s application.
Fundraising Commitment: In the event Applicant is accepted to the 261 Fearless Charity Team, applicant must raise a minimum of US$ 4,000 to join the 261 Fearless Charity Team. Forty percent (40%) of this amount (US$1,600) is due no later than September 1, 2019, in order to stay on the team and keep the charity bib. To launch this commitment, each accepted applicant will pay a US$ 261 non-refundable Team deposit by credit card immediately upon acceptance to the Charity Team. This US$ 261 tax-deductible payment will secure the runner’s spot on the team and will be applied toward the individual’s fundraising goal. Once this payment is received, access will be granted to the fundraising tools and runner resources through 261 Fearless CORE communication platform. The remaining balance of the minimum US$ 4,000 must be received by 261 Fearless by October 30, 2019. If applicant has not reached the minimum in fundraising by that date, applicant will personally be responsible for the balance owed. 261 Fearless reserves the right to charge the balance owed to applicants credit card, net of credit card fees. Applicant Credit Card is required to be on file with 261 Fearless, Inc.
In the event Applicant is accepted to the 261 Fearless Charity Team, applicant must then register with the TCS New York City Marathon/New York Road Runners through the designated registration link that will be sent to the Applicant. Applicants are responsible for their own entry fee, paid directly to the New York Road Runners (NYRR). Entry Fees 2019: US Residents: NYRR Members US$ 255, Non-Members US$ 295, Non-U.S. Residents US$ 358)
Release and Contribution Commitment: Applicant hereby waives and releases any and all claims for damages Applicant may have against 261 Fearless and its employees, volunteers, consultants and product sponsors and partners for any and all injuries suffered or sustained by Applicant which are in any way related to the race, including, without limitation, resulting and/or related to training, planning sessions and travel. Applicant hereby agrees that the foregoing release shall apply to and be binding upon Applicant’s heirs, executors, administrators and legal representatives. Applicant further attests and certifies that Applicant is physically fit and will have sufficiently trained for the Race and that, at a reasonable time prior to the Race, Applicant’s qualified medical doctor shall verify to Applicant that his/her physical condition is suitable for participation in the Race.
Release of Image for PR: Applicant grants permission for use of Applicant’s name, likeness, image, voice, and/or appearance as such may be embodied in any pictures, photos, video recordings, social media postings, digital images, and the like, concerning Applicant’s participation in Team 261 Fearless., without compensation. Applicant understands and agrees that any content described in the aforementioned sentence may or may not contain attributions specifically identifying Applicant or any of Applicant’s property.
Applicant declares that Applicant has exercised his/her own judgment in signing this agreement and Applicant further declares that the decision to accept the Terms and Conditions to apply was voluntary and not based on or influenced by any representation of 261 Fearless, Inc.
